KAGO prepares funding-ready business documents to a high professional standard. What we cannot do is promise an outcome. Please read this disclaimer carefully before you buy or rely on any pack we deliver.

Who we are

KAGO is a brand of Kutlwano Holdings, based in Soweto, Gauteng, South Africa. We build custom, funder-grade business packs for South African entrepreneurs. In this disclaimer, "we", "us" and "KAGO" mean Kutlwano Holdings trading as KAGO, and "you" means the customer who buys a pack.

No guarantee of funding or approval

KAGO does not guarantee, warrant or promise that any funder, bank, the NYDA, SEFA, a development finance institution, a government programme or any other person or institution will approve your application, offer you funding, or lend you money.

We prepare your documents to the standard that funders ask for, so that your application is taken seriously and can be assessed on its merits. The funding decision always belongs to the funder. It depends on that funder's own criteria, appetite, available money and processes, on the merits of your business, and on your own circumstances, none of which are within KAGO's control.

Financial figures are projections, not guaranteed income

The financial figures in your pack, including the financial model, the cash flow, the funding ask, projected turnover, projected profit, margins and any other numbers, are projections and modelled estimates. They are built on assumptions, on information you provide and on typical market conditions at the time of writing.

They are not a promise, guarantee or forecast of actual income, profit or business success. Real results depend on how the business is run, on market conditions, on pricing, on costs, on competition and on many factors that no plan can control. Your business may perform better or worse than the projections show. You should not treat any figure in the pack as a guaranteed result.

You are responsible for the information you provide

We build each pack from the information you give us in the intake form and in any communication with us. You are responsible for making sure that the information you provide is accurate, complete, honest and up to date.

We do not independently verify or audit the information you give us. If the information is wrong, incomplete or misleading, the pack will reflect that, and KAGO is not responsible for the consequences. Submitting false or misleading information to a funder is your responsibility and may have serious consequences for you.

Prepared to a professional standard, but outcomes depend on you and the funder

We take real care with every pack. That said, business planning involves judgement and estimates, and no document can remove the ordinary risks of starting or running a business. The outcome of any application, and the success of any business, depends on the funder's decision and on your own circumstances, choices and effort.

You remain fully responsible for your business, for your dealings with funders and third parties, and for complying with all laws, licences, permits, health and safety rules, tax obligations and regulations that apply to your business.

Limitation of liability

To the fullest extent allowed by South African law, KAGO and Kutlwano Holdings are not liable for any loss, damage, cost or expense, whether direct or indirect, that arises from a funder declining an application, from business results that differ from the projections, from your reliance on the pack, or from information you provided that was inaccurate or incomplete. Nothing in this disclaimer excludes any liability that cannot lawfully be excluded, including your rights under the Consumer Protection Act, 2008.

Governing law

This disclaimer is governed by the laws of the Republic of South Africa.
